Terms of Service

1. Service Description

Gravity SMS is a cloud-based SMS gateway that connects your RingCentral account to automation platforms and custom applications. We facilitate SMS sending and receiving through your RingCentral account. We are not a carrier or message originator.

2. Account & Access

You must provide accurate information when creating an account. You are responsible for your API keys and credentials. One RingCentral account is permitted per tenant. We may suspend accounts that violate these terms.

3. Acceptable Use

You must comply with all applicable laws, including the TCPA, CAN-SPAM, and CTIA guidelines. You must not send spam, unsolicited messages, or illegal content. You must not use the service for phishing, fraud, or harassment. You must have proper consent from message recipients and honor opt-out requests (e.g., STOP).

4. RingCentral

You bring your own RingCentral account and are subject to RingCentral's terms. We store encrypted OAuth tokens to maintain your connection. We are not responsible for RingCentral outages, rate limits, or account issues. You can disconnect your RingCentral account at any time.

5. API Usage

API keys are shown once and cannot be recovered; they can only be rotated. Rate limits apply per RingCentral's policies. We reserve the right to throttle or suspend abusive usage.

6. Billing & Subscriptions

Subscriptions are billed via Stripe; payment processing is subject to Stripe's terms. You authorize recurring charges according to your selected plan. Failed payments may result in service suspension; we will notify you before suspending. You may cancel your subscription at any time; access continues until the end of the billing period.

7. Data & Privacy

Our handling of data is described in our Privacy Policy. Message content passes through our system but is not mined, analyzed, or sold. We log messages for delivery tracking and debugging.

8. Availability & SLA

The service is provided "as is." We make reasonable efforts to maintain availability but do not guarantee uptime.

9. Limitation of Liability

We are not liable for failed message delivery due to RingCentral or carrier issues. We are not liable for content sent by tenants. Our liability is limited to damages not exceeding fees paid in the prior 12 months. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate at any time. On termination, your RingCentral connection is disconnected, API keys are invalidated, and data is deleted per our retention policy. We may terminate for violations of acceptable use.

11. Intellectual Property

Gravity SMS and its API are our property. You retain ownership of your message content and data.

12. SMS Terms of Service

By opting in to receive SMS messages from Gravity SMS, you consent to receiving text messages related to your account, service notifications, and other communications as described at the time of opt-in. Message frequency varies based on your account activity and preferences. Message and data rates may apply.

You may opt out at any time by replying STOP to any message you receive. After opting out, you will receive a final confirmation message and no further texts will be sent unless you re-subscribe. For assistance, reply HELP to any message or contact us at support@gravitysms.com.

Your phone number and SMS-related data will not be shared with third parties or affiliates for marketing purposes. Your use of SMS services is also subject to our Privacy Policy and these Terms of Service.

13. Changes to Terms

We may update these terms from time to time. Continued use constitutes acceptance. Material changes will be communicated via email or dashboard notification.

14. Governing Law

These terms are governed by the laws of the State of Indiana, United States.
